Regulations & Restrictions
Active Duty Gear, Inc. offers several items that may be restricted for sale in the United States of America by federal, state, and local laws and regulations. Sale of these restricted items may be limited to United States Military, Law Enforcement, Correctional Facility Personnel, Security Guards, Peace Officers, and various other authorized users. They may also be restricted for anyone to use or own based on say blade size (if a knife) or some other feature in a specific City, County or other local jurisdiction. At this time Active Duty Gear will only sell product in The United States and Canada. The further sale of any restricted product outside of these two countries is strictly prohibited and is a violation of US Federal Law.
Active Duty Gear makes its best effort to ensure that it remains current on all Federal and State laws and regulations as applicable. Please be aware that United States federal, state, and/or local laws and regulations are complex and are subject to change at any time and often do. Therefore, any summaries of such laws and regulations provided by Active Duty Gear can never be considered as the current law in any location. ADG at best provides a guideline and makes potential buys aware that they are responsible for their actions and purchases. Active Duty Gear can never and will never serve as legal advice or counsel in any way at any time. It is ultimately the Customer's responsibility to investigate and ensure that any item is legal to use, carry, possess, purchase and/or own within the Customer's intended federal, state and/or local area.
Items regulated by United States federal, state, and/or local laws and regulations may include, but are not limited to, Body Armor, Helmets, Shields, Entry Tools, Lasers, Batons, Insignia, Restraints, Handcuffs, Gun Accessories and Gun Parts, Knives, Automatic Knives, Pepper Spray, and Stun Guns. Purchase of any restricted item may require various documents, including, but not limited to, a purchase order on department or institution letterhead, an official identification, and/or additional certification forms.
Active Duty Gear expressly reserves the right to require any documentation as it deems necessary to ensure compliance with any applicable laws and regulations or any other purpose. Further, Active Duty Gear’s reservation of rights includes, but is not limited to, the right to require end user and end use information and/or compliance certification forms from any Customer.
By proceeding with a transaction to purchase any restricted item, the Customer certifies that (1) the Customer has reviewed all United States federal, state, and/or local laws and regulations related to the use, possession, purchase and/or ownership of the restricted item(s); (2) the Customer is legally permitted to use, possess, purchase and/or own the restricted item(s); (3) the Customer does not intend to transfer the item(s) contrary to United States federal, state, and/or local laws and regulations; (4) the item(s) will be used for lawful purposes only, and the Customer is not associated with any criminal group or criminal enterprise; (5) the Customer is at least 18 years of age, or of the appropriate legal age for an item according to applicable federal, state, and/or local laws and regulations; (6) the Customer is under no legal disability that would prevent the Customer from using, possessing, purchasing, owning, and/or transferring the item(s); and (7) the Customer has read and understands the export policy and (8) if applicable, Customer understands and agrees to restrictions on the return of certain regulated products.
By purchasing any item from Active Duty Gear, the Customer certifies that the Customer will comply with any and all requirements imposed by applicable U.S. federal, state, and local laws, regulations, and administrative policies.
Active Duty Gear does not manufacture, produce or assemble the products and is not responsible for any claims relating to infringement by the product of third party intellectual property rights. Active Duty Gear makes no warranties, express or implied, with respect to the quality of the products or the results that customer may achieve utilizing such products, including, but not limited to, the implied warranties of merchantability and fitness for particular purpose (to the extent applicable) which are hereby disclaimed and excluded. In no event will Active Duty Gear be liable to Customer for any lose of profits or indirect, incidental, consequential, special, exemplary or punitive damages. Active Duty Gear’s liability is limited to replacing defective goods where warrantied. Pursuant to the provisions of the California Song-Beverly Consumer Warranty Act, this product is sold "AS IS" and "WITH ALL FAULTS".
Any controversy or claim arising out of or relating to Customer's purchase of any product from Active Duty gear shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. Venue for any arbitration, or any legal dispute, shall lie only in the County of Los Angeles, California and in no other venue or forum. The laws of California shall apply to all transactions.
